EMPLOYMENT LAW PRACTICE

 

Mr. Miller's employment law experience began in 1992-1994, while assisting on a variety of employment discrimination and civil rights cases as a law clerk to the Hon. Edward H. Johnstone, then Chief Judge of the United States District Court for the Western District of Kentucky. He has since handled multiple employment cases as an attorney in private practice over the last fifteen years, including EEOC proceedings and cases before Kentucky and federal trial and appellate courts. In 1996 and 1997, he served as acting General Counsel for Murray State University, developing equal opportunity and anti-discrimination policies and handling various employment law matters.

In 2006-2008, Mr. Miller represented a private government contractor and its Executive Director in the employment litigation styled Osborn v. Haley, 549 U.S. 225 (2007), filing a merits brief in support of the winning argument and appearing at counsel table before the Supreme Court of the United States. (Links to the Osborn Opinion and Brief appear on Mr. Miller's page on the WRHS website). He also represented the defendant in the case of Midwestern Ins. Alliance, Inc. v. Coffman, 7 S.W.3d 393 (Ky.App. 1999), obtaining a reversal in favor of the insurer regarding interpretation of an employer's liability policy. In 2009, he obtained dismissal of a wrongful termination lawsuit filed in federal court against Delta Airline, Inc. and its in-house counsel.

In addition to employment defense litigation, Mr. Miller regularly counsels corporate clients regarding employment law matters, including drafting and revision of personnel policy manuals. Representative clients include Midwestern Insurance Alliance, Inc.; Enterprise Rent-A-Car Company of Kentucky; ISP Chemicals, Inc.; Jennie Stuart Medical Center; A&K Construction, Inc.; and Four Rivers Behavioral Health. He recently gave a presentation to a large group of western Kentucky employers, entitled: "Wrongful Termination Claims in Kentucky: Lessons Learned from the Cold Call." He is a member of the employment law practice sections of the Kentucky and American Bar Associations.

Mr. Miller's practice also emphasizes construction law and general civil litigation, with significant experience in insurance defense work.
